VTUBER MODEL TERMS AND CONDITIONS

DISCLAIMERBy purchasing my art services you automatically agree to the following conditions. Please read this entirely and carefully.If you have any questions, please contact me.PROCEDUREThe client will be expected to first read my TOS and understand my general commission prices and rules.
Please be 100% sure that you want to commission me for a model and that you have the available funds.You will then contact me regarding your proposed project or fill out the form I provided, revealing any details.
References must be clear and full in color.
Additional information can be added, be clear when giving details or asking for changes.
Use of example images, palettes and gallery examples is encouraged.
Wait for my answer so we can discuss further process.PAYMENT PROCESSI'll only accept PayPal as payment.You will be charged a booking fee of 5% of the final price to secure your slot, this fee is non-refundable even if you decide to cancel the commission.I require full payment or, in case of a payment plan, partial payment before I start working on the model.In case of a payment plan I will only do the amount of work that fits the amount of money you have already paid.
For example, if you only pay 50% I will do the sketch, lineart and adding base colors.
When you pay the other 50% I will do the rest.REFUND AND CANCELLATIONI can refund 100% of the payment ONLY if I haven't started working on the sketch.
Once I start your commission I can't refund the full amount.Not started: 100% refund
(Clean) sketch: 70% refund + sketch is sent
Once I'll reach the lineart status there'll be NO REFUNDS.Please keep in mind that once you cancel a commission your commission slot is permanently lost.CHANGES
I will send you several WIPs when I start the model, so you can tell me if you'd like anything to be changed. Once the model is finished I can do small changes such as color adjustments and/or adding tiny details I may have forgotten. I will not make any big changes afterwards, it is your responsibility
to ensure that your order contains the details you want me to follow.I won't redraw commissions unless payment is sent for a second order.ARTISTBy commissioning me you're purchasing my services as an artist only.
I retain all copyrights over my work, which include but aren't limited to the right to:
redistribute, reproduce or use it as a sample for sales / self-promotion unless otherwise agreed upon.
I'll respect your privacy request if you'd prefer me not to post your project publicly.
I won't claim the intellectual property or reuse / resell your project / design for personal or commercial projects unless agreed upon.
I reserve the right to decline any project or client for any reason without questions.I reserve the right to use rejected sketches for any future projects, be it personal or otherwise.DEADLINEYou may set a deadline if you wish, but it must be reasonable. I don't have time to work on your piece 24/7.
If you need your finished piece quickly and wish for your commission to be PRIORITY there'll be a fee that must be paid first.CLIENTThe commissioner may display my work on external sites as long as it is visibly credited or linked back to me and they don't claim it as their art.Once the model has been completed, you may use it for but not limited to: model reveals, commissioning art, overlays, logos, using as a PNG-Tuber until it is rigged, etc.
You retain rights to the intellectual property.YOU AREN'T ALLOWED TO......change, modify, edit the psd or png without my permission.
...to request another artist to alter/recolor the model.
...share the psd of the model with anyone else than the rigger or people I agreed to.
...sell the model without my permission.
...use my art as a base for anything, meaning you're not allowed to trace over my artwork in any way.
...claim the model as your own or anyone elses than mine.RIGGINGThe rigger is allowed to make small changes if needed. If there is anything bigger that needs to be changed / separated / modified / etc. feel free to contact me and I will gladly make these changes.By commissioning me, it means you have read and accepted all the terms outlined above.

TERMS OF SERVICEBy purchasing any adoptable design from me, you agree that you have read and accepted all the terms described herein. By purchasing an Adoptable Design from me, you acknowledge that you are buying a finished and satisfactory product. You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated, and provide all image credits to me.You, the Client, understand that there will be no refunds once you have paid and received your files.All purchases are final.Credit the art if used.Do not claim the art or the design as your original work.Do not post the un-watermarked piece without crediting me and any of my collaboration partners (if any).I still retain the right to use the art that you have purchased as future 'commission examples' and to use the character for any commercial use unless you, the Client, have also the commercial rights.The Client may not use any of my art for commercial use unless you have my consent.Discuss any commercial fees with me beforehand.Commercial fees will be priced higher than something purchased for solely personal use.Please contact me if you wish to turn the design and its art into a commercial asset. A Vtuber model, a twitch / youtube / business asset, and so on.You may use the Artwork for personal use including but not limited to: avatars, phone or computer wallpapers, and personal website/profile displays.You reserve the right to print or create an otherwise physical reproduction of the Artwork as long as it is for your PERSONAL use only (ie. NOT for sale).The Client does not have the right to mint/sell my art for NFTs or involve my art in any Crypto-related projects.The Client may not use my art for AI learning programs including but not limited to: Stable Diffusion, Midjourney, etc.PAYMENT PROCESSThe winner of the Auction will be expected to pay the full or an agreed-upon amount within 48 hours.Paypal only unless specified otherwise. I will ask for your Paypal Email and send you an Invoice.Do not send money through other means unless I have specifically requested it.Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.PAYMENT PLANBy agreeing to a Payment Plan, the Client agrees that there will be a concrete date for payment to be fully settled.The Client agrees that you will pay the amount in full and will not back out of the transaction.Any payment plans between the Client and Artist will be discussed and adhered to via Paypal invoicing. Minimum Dues and an estimate of when the total amount will be paid in full will be discussed between Artist and the Client.The Client will be expected to adhere to these agreements and pay the total amount in full.
